Workshop, Course and Programme Terms & Conditions

GENERAL TERMS

  1. By becoming a student of The Sculpture School Ltd you enter into a contract by which you:

1.1. Confirm that you are willing to participate fully in the workshop, course or programme
1.2 Agree to pay the relevant fees.
1.3 Agree not to plagiarise or in any way try to pass yourself off as competent by means of deception.
1.4 Agree to take full responsibility for your actions and behaviours

1.5 Agree not to copy or share the course materials supplied with anyone at all.

1.6 Confirm that you have, or are willing to secure access to, additional relevant materials where the course necessitates this.

  1. We reserve the right to refuse students for any reason.
  2. Enrolments on the courses and programmes are subject to The Sculpture School Ltd Terms & Conditions of business (available to view on the website). The One Year Programme is subject to additional terms & conditions.

APPLICATION OF THESE TERMS

  1. Payment of the requisite fee is an offer by you to enter into a binding contract with us, which we are free to accept or decline at our absolute discretion.
  2. We intend to rely upon these Terms and any document expressly referred to in them in relation to the Contract between you and us.
  3. We have the right to revise and amend these Terms from time to time. You will be subject to our Terms (including policies and procedures) in force at the time that you enrol on a workshop, course or programme with us, unless any change to those policies or these Terms is required by law or government or regulatory authority in which case the same will apply to workshop, courses and programmes you have enrolled on or started.

AGE REQUIREMENTS

You must be 18 years or over to attend our workshops and courses.

APPLICATION, ENROLMENT AND PAYMENT

  1. Booking implies a commitment to pay the published fees, subject to your eligibility for the course booked.
  2. Deposits, where payable are non-refundable.
  1. The balance of fees (i.e. the total fee(s) less any deposit previously paid) is due no later than 30 days before the course starts or immediately if the course is due to start less than 30 days after booking unless terms are agreed otherwise.
  2. Students are liable for any bank charges incurred in payment of fees.
  3. We reserve the right to increase fees at anytime and/or change payment of the fees without notice. This will not affect those who have already booked.
  4. Payment for goods and services is taken as acceptance in full of these terms & conditions.

LATE PAYMENTS

  1. Where payments are made by agreed instalments and those instalments have not been paid on the due date, we reserve the right to cancel your booking.

CHANGES AND CANCELLATIONS BY YOU

All amounts payable must be received 30 days before the commencement of the Course. Your place on the Course is not confirmed and we have no obligation to you until full payment is received.

  1. If you exercise your legal right to cancel under the Consumer Contracts Regulations (cancelling within 14 working days of booking) you will receive a full refund of the price you paid when booking. We will process the refund due to you as soon as possible and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation.
  2. If your course is due to start within 14 working days of when a booking is made, your legal right to cancel under the Consumer Contracts Regulations will not apply.
  3. If, after the 14-day period referred to above has elapsed and it is more than 12 weeks before your workshop, course or programme is due to start, and you decide to cancel due to circumstances beyond your control, we are willing to offer a transfer to a course on a different date of the same value (or put your fee towards a course of greater value if you pay the additional sum required). You will not be entitled to a refund.

 

  1. Postponement requests to transfer to an alternative workshop or course (due to unforeseen circumstances) are limited to one occasion only.
  2. If cancellation by you occurs less than 12 weeks before the start of the course, you will not be entitled to a refund, nor will we offer a transfer of your booking or a credit note.
  3. Friends and family may attend in your place for any Course providing we have been given 24hrs notice before the Course commences. You will need to provide us with the names and contact details of anyone attending in your place.
  4. Courses bought as gifts are subject to the same cancellation policy.

CHANGES AND CANCELLATIONS BY US

  1. If circumstances arise that are beyond our control, it may be necessary from time to time to change/cancel dates, content, venues and prices from those published. Whilst we will make every effort to transfer your booking to the next available course, it should be noted that we will not be held liable for any costs/losses incurred as a result of any such changes. If we are no longer able to provide your workshop, course or programme we will offer you an alternative date. If this is not satisfactory, we will refund any fees paid to date.
  2. We reserve the right to remove from any workshop, course or programme, those that fail to comply with our standard practices and procedures. We reserve the right to refuse enrolments and/or suggest alternative arrangements if we believe that it will not be in our best interests of other participants and/or the individual concerned to be enrolled with us.

PERSONAL INFORMATION

  1. Students of The Sculpture School Ltd must provide an accurate and complete postal address, contact telephone number and e-mail address. We may refuse or cancel your enrolment if you do not supply these. Your details will not be used for any purpose other than the efficient and effective running of the business.
  2. The majority of correspondence with and from The Sculpture School Ltd is conducted electronically using e-mail and web-based protocols. Your details will be added automatically to our database. Your details will not be passed to any third party without your permission, unless requested by law or a similar authority. For more information on how we use your data please see our Privacy Policy on our website.
  1. The Sculpture School Ltd abides by the Data Protection Act.

 

LIABILITY AND CONTRACTUAL OBLIGATIONS

  1. Information, whether on the web or in any other form, is provided for the use of students and others at their own discretion. No liability will be accepted for the accuracy of any information or the consequences of its use by students or others.
  2. The Sculpture School Ltd will not be liable for:

28.1 the loss of any personal possessions.

28.2 any loss suffered by you which is indirect, special or consequential.

28.3 any loss suffered by you resulting from any event which is beyond the reasonable control of The Sculpture School.

  1. Depending on the workshop, course or programme purchased, The Sculpture School Ltd agrees to provide its students with some or all of the following:
  • Relevant course materials
  • Access to regular Q&A sessions
  • A suitable and appropriate assessment methodology

The Sculpture School Ltd reserves the right to terminate any enrolment if it suspects that any part of these terms and conditions have been broken.

JURISDICTION

  1. This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by the law of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over any such dispute or claim.

WEB-BASED COMMUNICATION & CODE OF CONDUCT

  1. As a student of The Sculpture School Ltd, you are solely responsible for your own communications and are responsible for the consequences of them.
  2. In consideration of being allowed to use the materials (including the web site and Facebook group), you agree that you will abide by these terms and conditions and in general will not:

32.1 Harass any other participant or representative of The Sculpture School Ltd.

32.2 Use the forum for any purpose in violation of local or national laws of any country.

32.3 Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.

 

32.4 Post material that is abusive, defamatory, embarrassing, harassing, hateful, inflammatory, obscene or threatening to any other member or member of staff.

32.5 Post sexually explicit language or images.

32.6 Post advertisements or solicitations of business.

32.7 Post chain letters or pyramid schemes.

32.8 Impersonate another delegate

32.9 Express or imply that The Sculpture School Ltd endorse any statements you make, without our specific written consent.

32.10 Collect or store personal information about other student without their personal consent.

32.11 Conduct any other activity that we consider is detrimental 

32.12 Plagiarise the work of others or in any way try to pass yourself off as competent by means of deception. 

32.13 Benefit commercially from the sale of a sculpture created on a course at The Sculpture School studio under the tuition of Andrew Sinclair MRSS without prior consent. (excluding the One Year Programme) 

  1. Our decision on these matters is final.

COPYRIGHT & INTELLECTUAL PROPERTY RIGHTS

  1. The learning materials and contents of the courses are copyright. This includes all content unless otherwise noted. The contents may not be copied and republished in any format, whole or in part. This includes (for example, but not limited to) copying text, copying pictures or video, copying images for use in brochures, websites or any other medium, copying review content (narrative, video or pictures), copying backgrounds and borders, or any other content.
  2. All material is the intellectual property of The Sculpture School Ltd (or the suppliers of the information where this is explicitly stated). Material is made available purely for the benefit of The Sculpture School Ltd’s corporate and individual students for their own personal use. It is not available for commercial use with other organisations.
  3. If students personally make their contact details available to other student, this is to enable networking and sharing of information between them. Under no circumstances are they to be used by students or their associates, or made available by students/associates to third parties, for mailing lists or other commercial purposes. 
  1. By becoming a student you grant to The Sculpture School Ltd a perpetual licence to display, reproduce or use your digital interactions and postings. You also grant to The Sculpture School Ltd a perpetual licence to use your postings either in the original form or modified and on any other media for the purpose of promotion of Pure Potential Learning.
  2. You may terminate your enrolment on a One Year course at any time by notifying The Sculpture School by email or in writing, the same cancellation terms apply. 

COMPLAINTS

  1. If you have a complaint about any procedure, product or service provided by The Sculpture School Ltd please contact us by email at info@thesculptureschool.co.uk

39.1 The Sculpture School takes their duty of care responsibilities very seriously. The Sculpture School treats all complaints positively and seriously. They handle complaints quickly and effectively and aim to keep the complainant informed and involved throughout, with the objective of resolving the matter as quickly as possible and learning and improving all the time.

 

RIGHTS AND RESPONSIBILITIES OF The Sculpture School Ltd

  1. The Sculpture School Ltd accepts no responsibility for the content of our site, which is provided ‘as is’, and with no warranty express or implied. Reviews and all our other content are offered as our opinion only.

 

ARTIST SALES/COMMISSION

  1. All work submitted to The Sculpture School for sale at physical exhibitions must be for sale unless otherwise specified and agreed in advance. Sales commission rates apply at 25%.

41.1 Copyright in all work submitted to and exhibited by The Sculpture School Ltd will remain the property of the artist. It is, however, a condition of participation and membership that The Sculpture School reserve the right to use all submitted images and/or text in whole or in part, together with film and photographic images taken at our events, exhibitions and residencies, for promotional and publicity purposes.

The Sculpture School shall also have the right of free reproduction of all submitted and exhibited works for all catalogues, posters, postcards, DVDs, exhibition website and other promotional and educational material. Any enquiries regarding copyright will be referred to the artist.

  1. Photographing your artwork. The Sculpture School recommends artists have their artwork professionally photographed wherever possible.

 

DATA PROTECTION & GDPR

  1. The Sculpture School will hold personal data supplied to it securely, in accordance with the Data Protection Act, 1998 and subsequent amendments to this legislation

In compliance with GDPR regulations:

The Sculpture School policy is to respect your personal information and your privacy. We will not share or sell the information we hold about you to any other 3rd party or organisation.

Payment of course fees will be taken as your unreserved acceptance of the entire contents of this document and consent to our storing and utilising as detailed the information supplied to us.

DISABILITY DISCRIMINATION AND EQUALITY

  1. The Sculpture School recognises and abides by the Disability discrimination and the Equality Act 2010

The Sculpture School has a policy of complete inclusivity for all and endeavours to ensure all its products, services and events are open and accessible to all. It will never discriminate against anyone on the basis of age, gender reassignment, sex (i.e. man or woman), race, religion or belief, pregnancy and maternity, marriage and civil partnership, sexual orientation and disability and furthermore, will always endeavour to make all reasonable adjustments required to working and delivery arrangements and/or premises, in order to ensure the disabled are not being disadvantaged in any way. 

 

DISQUALIFICATION

  1. The Sculpture School reserves the right to disqualify from participation or cancel the membership of any members, partners, patrons or collectors who fail to adhere to the rules, act in a way that does not adhere to The Sculpture School ethos or behave in such a way that does not reflect The Sculpture School values and high moral and ethical standards.
  2. Students shall act at all times with due regard to public morals, conventions and The Sculpture School ethos. If a student shall have committed or does commit any act, or if a student shall have conducted or does conduct themself in a manner, which shall be an offence involving moral turpitude under English Law, or which might tend to bring the student to public disrepute, contempt, scandal or ridicule, or which may embarrass, offend, insult or denigrate individuals or groups, or that may shock, insult or offend the community, The Sculpture School or public morals or decency or prejudice The Sculpture School, or which results in or is likely to result in actual or threatened claims against The Sculpture School, or which otherwise may reflect unfavourably upon

 

The Sculpture School, The Sculpture School shall have the right to terminate their agreement with the student at any time following the date on which the commission of such act, or such conduct, shall have become known to The Sculpture School.

Payment of the workshop, course or programme fee is taken as unreserved acceptance of the entire contents of this document. The Sculpture School reserve the right to update their terms & conditions of business at any time.

 

WORKSHOPS, COURSES & PROGRAMMES

WHAT’S INCLUDED

All materials are provided for the duration of the workshop and you will take home your armatures, back-irons, your clay sculpture to continue working on, a course manual and digital reference material. Model fees are included where applicable. Refreshments are plentiful and a daily light lunch is provided by local caterers. We are unable to cater for special dietary requirements.

We reserve the right to make amendments to course content without notice.

 

HEALTH & SAFETY

All participants should wear shoes with flat, non-slip soles and covered toes. We recommend wearing sensible, warm clothing ie. not your best outfit – we are not liable for any damage that occurs to clothing.

 

PHOTOGRAPHY

The Sculpture School have the right to use images of any piece of work created on our premises or under our tutelage. We own the copyright to use these images for promotional and marketing purposes. From time to time, we may photograph our courses & students for use in marketing and promotional material (including on our website and social media channels). One Year students are required to sign a ‘release form’ for personal photographs.

 

ACCOMMODATION

Prices do not include your accommodation. We are able to supply a list of known local accommodation providers in the area. Arrangements will be solely between the student and accommodation provider. The Sculpture School does not accept any responsibility for your accommodation arrangements. If you would prefer to stay on site, there are 2 Shepherd’s Huts and a Mezzanine Apartment available to book through our website: www.burnswood.co.uk

 

CERTIFICATION

The One Year Programme offers a Sculpture School certificate upon successful completion of a course. Certificates are issued at the discretion of the Tutors. Please note, to maintain the value of our course certificates, students that have a partial attendance record will find that reflected on their course certificate.
